7. JUDGING: During each Daily Entry Period, entrants may enter by posting a photo or video to Instagram using the hashtag #ChooseJoyContest and the tag @CupcakeVineyards. There are two prize levels (Level 1 Prize and Grand Prize), each with their own judging requirements.

  • Level 1 Prize:
    • Participants will be eligible to win a Level 1 prize depending on how many reactions their post has received on Instagram, which includes a “like” or “comment” on the post from a person other than the person who posted the photo or video (each a “Reaction”).
    • Each participant will be eligible for a Level 1 prize depending on the number of Reactions his/her post has received.
    • During each Daily Entry Period, Sponsor will display the required number of Reactions for the Level 1 prize. This information will be displayed at the Cupcake Vineyards Poptail Shop at the Coachella Valley Music and Arts Festival in Indio, California.
    • Each participant must show a Cupcake Vineyards brand ambassador his/her Instagram account and post. This assessment will be based on the number of Reactions the post receives as determined by the Sponsor at its sole discretion.
    • Each participant may receive no more than one (1) Level 1 prize per Daily Entry Period. Determination of the prize level will be based on only one (1) post. The total number of Reactions from multiple posts on the same day will not be counted together.
    • Winning a Level 1 prize does not disqualify you from being entered or winning the grand prize.
  • Grand Prize:
    • All entries that are posted with both the hashtag #ChooseJoyContest and the tag @CupcakeVineyards in each eligible time period will be combined, and two winners will be randomly selected among those entries. (One from Weekend One Entry Period and One from Weekend Two Entry Period)

9. DETERMINATION OF WINNERS: Level 1 Prizes: At the Cupcake Vineyards’ Poptail Shop at the Coachella Valley Music and Arts festival, each participant must show a Cupcake Vineyards brand ambassador his/her Instagram account and post. The Cupcake Vineyards brand ambassador will determine which prize level the post qualities for based on the requirements for each level for the applicable Daily Entry Period. This assessment will be based on the number of Reactions the post receives.

Participants may receive no more than one (1) prize per Daily Entry Period based on the number of Reactions to a single post. Determination of the prize level will be based on only one (1) post. The total number of Reactions from multiple posts posted on the same day will not be counted together in determining the applicable prize level. Personally identifiable information, including entry information received, will be used to verify eligibility and award the prize.

In the event of any dispute concerning the identity of any entrant of an Entry, the Entry will be deemed submitted by the natural person who is the authorized holder of the transmitting account. Sponsor and its agencies are not responsible for notifications that are misdirected because contact details as provided by the entrant are no longer correct, or for any other reason beyond the exclusive control of the Sponsor.

The exact number of prizes offered during each Daily Entry Period is subject to change as determined by Sponsor in its sole discretion.

Prizes are available on a first come, first served basis. As a limited number of prizes is available during each Daily Entry Period, participants are not guaranteed to win a prize based on their qualifying level and may not receive any prize depending on availability.

Before Level 1 prize is issued, each winner will be required to execute a Release of Liability. Winner must be at least 21 years of age and may be required to present a valid government-issued photo ID before prize is released.

Grand Prize: The potential Grand Prize winners will be notified via direct message on Instagram on or about Wednesday, April 18, 2018 for the Weekend One Entry Period and Wednesday, April 25, 2018 for the Weekend Two Entry Period, and will be required to sign an affidavit of eligibility and liability release within ten (10) days of notification or prize will be forfeited and may be awarded to another winner at sponsor’s sole discretion. If winner cannot be located or does not respond to attempt to be notified within three (3) days, or seventy-two (72) hours from initial notification, prize will automatically be forfeited, and an alternate winner may be selected at sponsor’s sole discretion. Winner’s guest will also be required to sign and return a Guest Affidavit of Eligibility/Release.

If the potential Grand Prize winner(s) cannot attend either of the Coachella Music and Arts Festival Events, the prize will be forfeited, and no other prize or additional compensation will be awarded. The Sponsor reserves the right to choose an alternate winner at its sole discretion.

All other expenses and costs, not expressly listed above, including, but not limited to, taxes, hotel accommodations, telephone charges, meals, transportation to and from the Festival, personal expenses, gratuities, incidental charges, or any other items not specifically described in these Official Rules are the sole responsibility of each Grand Prize winner. No transfer, substitution or cash equivalent for the prize will be permitted, except at the sole discretion of the Sponsor and the Sponsor’s obligation to the winner will be fulfilled, and no other additional compensation will be provided or due. In the event the Festival is cancelled for any reason, Sponsor will award a prize of equal or greater value, in their sole discretion.

No alcoholic beverages are included in the prize. In the event a Grand Prize winner or his/her guest consume alcoholic beverages (not provided by Sponsor) while attending the Festival, they do so at their own discretion and agree to hold the Sweepstakes Entities harmless from any subsequent damages or claims arising out of or related to such consumption.

Each winner is responsible for any and all federal, state and local taxes or assessments and each Grand Prize winner will receive an IRS Form 1099 from Sponsor or Administrator for the calendar year in which the prize is awarded for the value of the prize awarded.

Odds of winning are dependent upon the number of eligible entries received during the Entry Period.
